In the view that we have taken the appeal is allowed, the Judgment and decree of the High Court dismissing the suit against the State of Bihar is hereby set aside and a decree is granted against the State of Bihar in the same terms as was granted by the trial court. The appellant will be entitled to costs throughout.

Ltd.) entered into a cash credit agreement with the appellant Bank's Arrah Branch and pledged bags of sugar as security, the sugar being stored in godowns whose keys remained in the Bank's custody; by December 1946 the advance stood at about Rs. 3,20,486 against 6239 bags. In December 1949 the Rationing Officer and District Magistrate, acting under a seizure order, broke open the godown locks and removed 1818 bags (about 5000 maunds) of 27D sugar.…
