What the Court ordered
In the result we allow this appeal, set aside the order of the Claims Tribunal and remit the matter to the Claims Tribunal to deal with the appellant's claim-application in the light of the principle enunciated hereinabove. In the facts and circumstances of the case there will be no order as to costs.
