The appellant owned a 'trekker' used to carry passengers for hire, insured with the respondent company on the basis of a seating capacity of '13+1' (13 passengers plus driver), the premium being paid on that footing. He employed Shashi Bhushan Singh as a 'khalasi' (cleaner) on the vehicle. On 21.10.1998 the vehicle met with an accident in which the khalasi died, and his legal heirs claimed compensation before the Workmen's Compensation Court against the owner and the insurer.…
