What the Court ordered
For the foregoing reasons, we are of the view that the findings and reasons recorded by the High Court on the contentious points framed by it 56 Page 57 JUDGMENT C.A. Nos.77-84 of 2004 are totally erroneous both on facts and in law and therefore the same are required to be interfered with by this Court and hence the appeals must succeed.
