In the result, for the above-said reasons, the appeal is partly allowed and the judgment and order dated 19.04.2006 of the Division Bench of the High Court affirming the order of the learned Single Judge in Arbitration Petition No. 423 of 2004 whereby the Award of the Arbitral Tribunal was upheld, shall stand modified in the aforesaid terms and to the extent indicated above.
