In brief
The appellant, a 35-year-old destitute woman abandoned by her husband and family, was taken from a footpath in Patna to the 'Shanti Kutir' shelter home in January 2017, where she was found to be pregnant and HIV positive. In early March, at about the 17th week, she told the doctors at Patna Medical College Hospital that she had been raped and asked that the pregnancy be terminated; the hospital instead called her father and brother to sign a consent form and still did not carry out the termination, and again failed to do so on 3 April when the pregnancy had reached 20 weeks.…
