In brief
The private respondents worked at ONGC's establishment as workmen engaged through contractors, and claimed gratuity from ONGC as principal employer. The contract between ONGC and the contractors (Clause 12.4.1) expressly recorded that it was a job contract at arm's length creating no employer-employee relationship between ONGC and the contractors' workmen. The workmen approached the Controlling Authority under the Payment of Gratuity Act, which held ONGC liable to pay gratuity notwithstanding the objection that it was not the employer and that the Authority lacked jurisdiction to determine liability.…
