In brief
The appellant was awarded the work of upgradation of the Matiana, Mahori to Chhaila road (Km 0/00 to 25/650) under PMGSY package No. HP-09-694 on 15.03.2024, at a cost of about Rs. 23 crores. The rival bidder, M/s PK Construction Pvt. Ltd., complained against the award but later withdrew the complaint; a PIL was then filed before the High Court of Himachal Pradesh by a petitioner whom this Court found to be the alter ego of that unsuccessful bidder, raising grounds essentially of inter-se comparative assessment of the two bids (the appellant's experience being as sub-contractor rather than prime contractor, operation under two names, non-fulfilment of sub-contracting conditions and variance in the work experience certificate).…
