In brief
A bus registered in the name of Kidzee Corner School, Gwalior was requisitioned by the District Magistrate/District Election Officer for Gram Panchayat election duty. On 23 January 2010, while under the orders and command of the election authorities, the bus struck a motorcycle and killed its rider. The Motor Accident Claims Tribunal awarded Rs 5,13,500 with 6% interest, fastening liability on the insurer, National Insurance Co. Ltd. On cross-appeals the High Court enhanced the compensation to Rs 27,01,556 and shifted liability from the insurer to the requisitioning authority; the vehicle had been supplied with its driver, and no staff had been requisitioned under Section 159(2) of the Representation of the People Act.
