The plaintiffs, a son and his mother, were indebted to various financial institutions and government departments and executed two registered sale deeds dated 10.03.1975 in favour of the defendant, each for a consideration of Rs.7,000/-, of which Rs.2,500/- each was paid over and Rs.4,500/- each was expressly retained by the defendant under the recitals to clear the plaintiffs' outstanding dues. The defendant did not discharge those dues, and on being approached repeatedly he executed two further agreements (1975 and 1976) undertaking to pay the balance consideration and to repay all the government loans; these too went unperformed.…
