For the foregoing reasons, these appeals are allowed. The judgment and order dated 20.03.2026 passed by the Division Bench of the High Court of Delhi at New Delhi in FAO (OS) No.96 of 2022, FAO(OS) NO.97 OF 2022, FAO(OS) No. 98 of 2022, FAO(OS) NO.99 OF 2022, FAO(OS) NO.33 OF 2024 and FAO(OS) NO.49 OF 2024 is set aside, and the order dated 29.07.2022 of the learned Single Judge is restored.

In brief
The testator, Shri Devinder Singh Chaudhary, built up companies, LLPs and trusts in which the capital was held principally by him and his wife (the original plaintiff), and died on 05.12.2009 leaving rival claims of a Will dated 26.03.2004, a later Will dated 04.10.2008, and intestacy. After his death, his granddaughter (defendant No.4) and her family moved in with the elderly widow, and between 19.12.2018 and 06.06.2019 the widow executed a series of gift deeds and LLP transfer agreements passing her shareholding and LLP capital in the family entities to defendant No.4, together with a farmhouse sale of Rs.4.72 crores and about Rs.50 crores in loans and advances, with which defendant Nos.4 and 9 acquired flats, a factory and luxury cars.…
