For the aforesaid reasons, the Order of Division Bench rendered in L.P.A. No. 648 of 2018 is set aside and the Order of the Single Judge dated 05.09.2018 passed in W.P. (C) No. 6054 of 2017 is restored by allowing this Appeal with no order as to costs.

In brief
The petitioner company held a 3000 KVA HTSS electricity connection which suffered a breakdown after a blast in the cubicle metering unit; on 16.06.2017 the respondent Nigam's officials repaired it, replacing a cracked B-phase CT, and recorded that the meter reading and sealing were correct. A surprise inspection on 26.09.2017 recorded that the metering cubicle was housed under a metal sheet making the CT/PT easily approachable, that the nut carrying the GPC seal appeared welded at mid-point, that two holes existed in the meter chamber and that the check meter cable slot had extra space, while also remarking that all plastic/paper seals were found correct and the door could not be opened without opening the seal.…
