In brief
NTPC issued a Request for Qualification for supply of natural gas to its power plants and, on RIL's financial proposal, issued a Letter of Intent dated 16.06.2004, which RIL accepted subject to a Gas Sale and Purchase Agreement to be negotiated. NTPC sued for a declaration that a binding contract existed and for specific performance of supply of 132 trillion BTU of gas over 17 years. In earlier rounds, RIL's applications for discovery of NTPC's internal documents and for leave to produce its own internal documents/notings were rejected as irrelevant to whether a concluded contract existed, and those orders attained finality; this Court on 28.02.2019 further held that oral evidence could not be led on the contents of such excluded internal documents, e-mails and internal meetings, though the fact that meetings/discussions occurred was not excluded.…
