The criminal proceedings shall stand quashed as against the appellant. If the accused is in prison, she shall be released forthwith and if she is on bail, her bail bonds shall stand cancelled. 8. The appeal is allowed.

The second respondent lodged an FIR alleging that the appellant's son had obtained sexual favours from her on a promise of marriage and had misappropriated the proceeds of the sale of her car, and that the appellant, his mother, had actively connived in the false promise of marriage. On a reading of the First Information Statement, the Court found the relationship to have been consensual, with bland and unsubstantiated allegations interjected into the narrative, including an episode where the respondent first rejected and then re-accepted the marriage proposal.…
