Respondent no.1 was serving as a Lecturer when, pursuant to a Government Resolution dated 10.09.2001, he was declared surplus and disengaged from service. Under the State Government's policy, disengaged surplus employees were to be absorbed against the post held, an equivalent post, or, subject to availability, a lower post in another institution of the same category. He was in fact absorbed as Lecturer in respondent no.3-Institute and superannuated in 2024, but claimed that he ought to have been absorbed directly as Head of Department (Civil Engineering), relying on the identity of pay scales and on the MEPS Act, 1977 provision that the post be filled by the senior-most Lecturer.…
