Civil Appeal Nos. 10756 and 10757 of 2026 are disposed of in the light of the findings of this Court on the Contributory Negligence. Consequently, the composition granted by the High Court in the Impugned Judgment in Civil Appeal Nos. 10756 and 10757 of 2026 is confirmed but the apportionment referred to in the Impugned Order (v) (b), (c) is modified and is exclusively payable by K.S.R.T.C. Civil Appeal Nos. 10755 and 10758 of 2026 are allowed. The claimant is awarded the compensation of Rs.50,81,876 (Rupees Fifty Lakhs Eighty One Thousand Eight Hundred and Seventy Six) with interest at the rate of 6 per cent per annum from the date of filing of the claim petition till the date of realisation.

In brief
On 14.10.2005 at about 1:20 AM on NH-48 near Kunigal, a Hyundai Santro driven by the appellant's husband Nandan Shet collided with a KSRTC heavy passenger bus driven by RW1. The appellant's husband, her mother-in-law Geetha Shet and a family friend died; the appellant, a rear-seat passenger and then an Associate Manager at Accenture, suffered grievous injuries. The FIR and charge sheet were filed only against the bus driver, and the bus conductor, who was seated beside the driver, stated in his Section 161 CrPC statement that the bus was driven rashly and dragged the car 50-60 feet; the bus driver was later acquitted in CC No. 1002 of 2005 on benefit of doubt and the conductor was never examined by KSRTC.…
