In brief
The appellant, Vyakti Vikas Kendra India, obtained DDA's permission dated 15.12.2015 and was handed roughly 25 hectares on the active Yamuna floodplain upstream of the DND flyway to hold the World Culture Festival from 11-13 March 2016. Immediately on allotment the appellant wrote to DDA on 14.12.2015 pointing out large quantities of construction debris on the site, and DDA on 21.12.2015 permitted its removal, confirming the site was already in a damaged condition; earlier expert reports of 19.04.2014 and October 2015 and the Tribunal's own order of 14.07.2015 in the Yamuna matter had likewise recorded the floodplain as degraded and the restoration directions of the 13.01.2015 judgment as unimplemented.…
