On 10.04.2011 a heavy goods vehicle hit a motorcycle near Brijghat Bridge; the rider, Sushant Prabhakaran (33, a Manager at Ericsson India), was run over and died instantly, and the pillion rider Priyanka Das (35, a Deputy Group Manager at IBM Daksh) suffered pelvic fracture, perineal degloving, post-traumatic bilateral cortical blindness and a permanent colostomy stoma. In the death claim the Tribunal found the truck driver rash and negligent on preponderance of probabilities, rejected the insurer's fitness-certificate defence on the strength of the registration certificate, awarded Rs.82,56,152 using a multiplier of 16 keyed to the deceased's age, and held Priyanka Das was not the legally wedded wife (records showed she had described him as her fiance), apportioning only a small share to her, which the High Court raised to Rs.7,50,000.…
