The appellant applied to UPSIDA for allotment of plots E-25 and E-26 (together 0.89 acre) in the Babrala industrial area to set up a Common Bio-medical Waste Treatment Facility, and filed a Form 1 application with the UP SEIAA, obtaining a standard ToR on 17.08.2021. Its CBWTF allotment request was rejected and the plots were instead allotted for 'fabrication of industrial equipment'; on that footing a first CTE and first EC were obtained, which the NGT in Aniruda Panwar set aside as void for breach of Clauses 2 and 7 of the CPCB Revised Guidelines, 2016, with liberty to re-apply after procuring more land or seeking land relaxation.…
