In brief
The respondents were engaged by the Punjab School Education Board as Clerks and Peons between 1993 and 1996 on contract/ad hoc/daily-wage/work-charge terms, initially in 89-day spells, with subsequent breaks caused variously by administrative exigencies and by High Court orders limiting continuation. After several rounds of unsuccessful litigation for regularization, a Board committee on 09.07.2004 recommended adopting the Punjab Government's regularization policy dated 23.01.2001 mutatis mutandis as a one-time humanitarian measure; the Board accepted this on 13.07.2004, issued a public notice on 18.07.2004 that was not open to the general public but merely conveyed the decision to appoint those already working against permanent vacant posts, and issued letters from August 2004 with regular pay scales.…
