In view of the above, we find no good reason to interfere with the concurrent judgments convicting the accused and sentencing him under Section 506 of the IPC, details of which have been set out hereinabove.

On 26.11.2019 the appellant dragged the prosecutrix into bushes at Mokoidaling, Sutnga, threatened to kill her and committed penetrative sexual assault; she struck him on the forehead with a stone and escaped, and her mother lodged an FIR the next day describing her as 13 years old. Medical examination of the victim showed a torn hymen and partial penile penetration with blood on the vaginal swab, the appellant was found with a cut injury on his left lateral forehead, FSL found blood of the appellant's group on the victim's jacket, pants and underwear and seminal staining on the appellant's underwear, and the victim identified him in all three rounds of the TIP.…
